The Cook Group Secures Complete Summary Judgment Victory in Cook County Asbestos Litigation

CHICAGO — The Cook Group is pleased to announce a complete defense victory on behalf of a manufacturing client in asbestos litigation pending before the Circuit Court of Cook County, Illinois.
The Court granted summary judgment in favor of The Cook Group’s client, dismissing all claims after finding that the plaintiff failed to present sufficient evidence to create a genuine issue of material fact regarding duty, product exposure and causation.
Throughout the litigation, The Cook Group maintained that the plaintiff could not establish actual exposure to an asbestos-containing product for which the client was legally responsible or demonstrate that the client owed a duty under the circumstances presented. The defense further argued that attempts to connect the client to the alleged exposure were based on assumptions and speculation rather than competent evidence.
The Court agreed, concluding that the plaintiff’s evidence was insufficient to survive summary judgment and that no duty was owed by the client under the facts presented.
The litigation strategy and summary judgment briefing were developed by Christopher Ball and Thomas Gordon of The Cook Group’s Chicago office. Meredith S. Hudgens presented oral argument on behalf of the client. Hudgens leads the firm’s Chicago asbestos and toxic tort practice alongside Jackie Miller.
“This decision underscores a principle that is often lost in high-volume asbestos litigation: defendants are entitled to judgment when plaintiffs cannot prove actual exposure or establish a legal duty through competent evidence,” said Hudgens. “Our team remained focused on the evidentiary record and the legal standards applicable to our client from the outset, and we are pleased to have secured a complete dismissal on its behalf.”
