Dismissal Secured in Illinois Toxic Tort Action

The Cook Group successfully obtained a full dismissal with prejudice of all claims against a non-manufacturing retailer in a toxic tort action pending in the Circuit Court of Cook County, Illinois.

The matter was led by Jackie Miller, with the motion to dismiss researched and drafted by Christopher Ball and argued before the Court by Thomas G. Grace. Together, the team secured an early and complete dismissal based on established Illinois law.

The plaintiff alleged injuries stemming from products purchased decades ago and sought to impose liability on a retailer despite the absence of any manufacturing role. Relying on statutory protections afforded to innocent sellers, the Cook Group moved to dismiss the claims as legally deficient and untimely.

The Court granted the motion on multiple independent grounds, including:

  • The claims were barred by the applicable statute of limitations.
  • The claims were barred by the statute of repose, as the alleged exposures dated back to the 1970s and 1980s.
  • The retailer qualified for dismissal under Illinois’s seller’s exception (735 ILCS 5/2-621), which shields non-manufacturing sellers from liability in product liability actions.

In a detailed memorandum order, the Court further concluded that the retailer had been improperly added as a defendant in a refiled action long after statutory deadlines had expired. The ruling rejected the plaintiff’s attempt to revive stale claims through procedural maneuvering, finding no support for such efforts under Illinois law.

Following the dismissal, the plaintiff sought reconsideration and attempted to reinstate the claims. The Cook Group opposed the motion in writing and at oral argument. The Court denied reconsideration and reaffirmed the dismissal with prejudice, confirming that the retailer was properly dismissed from the case.

No appeal was pursued, and the dismissal is now final.

This early resolution avoided prolonged discovery, unnecessary litigation expense, and the operational burden that extended litigation can place on small businesses.
